What's the Point? is a free story pointing tool designed for agile teams to estimate work and collaborate in real-time. The Service allows users to:

  • Create and join pointing sessions
  • Vote on story points using various estimation scales
  • Collaborate with team members in real-time
  • Customize session settings

3. User Responsibilities

3.1 Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Use the Service in any way that violates any applicable federal, state, local, or international law
  • Transmit any material that is defamatory, offensive, or otherwise objectionable
  • Attempt to gain unauthorized access to any portion of the Service or any systems or networks connected to the Service
  • Use any automated system or software to extract data from the Service for commercial purposes

  • Impersonate or attempt to impersonate another user or person

3.2 Account Security

You are responsible for maintaining the confidentiality of any session URLs you create or share. Do not share session links publicly unless you intend for anyone to join.

4. Intellectual Property Rights

The Service and its original content, features, and functionality are owned by What's the Point? and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain ownership of any content you create or share within sessions. By using the Service, you grant us a limited license to transmit and display your content to other session participants for the purpose of providing the Service.

5. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability or fitness for a particular purpose
  • Warranties that the Service will be uninterrupted, timely, secure, or error-free
  • Warranties regarding the accuracy, reliability, correctness, or completeness of any information, data, results, or calculations obtained through the Service
  • Warranties that defects will be corrected
  • Warranties that the Service or any content is free from errors, bugs, viruses, or other harmful components

We do not warrant that the Service will meet your requirements or that the operation of the Service will be uninterrupted or error-free. THE SERVICE MAY CONTAIN INACCURACIES, ERRORS, OR BUGS. 6. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WHAT'S THE POINT?, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR CONTRIBUTORS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION:

  • Loss of profits, revenue, data, use, goodwill, or other intangible losses
  • Damages resulting from your access to or use of (or inability to access or use) the Service
  • Damages resulting from any conduct or content of any third party on the Service
  • Unauthorized access, use, or alteration of your transmissions or content
  • Any errors, mistakes, or inaccuracies in data, results, or content provided by the Service
  • Personal injury, property damage, or any other damages of any kind whatsoever
  • Business decisions made in reliance on data or results from the Service

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED ZERO DOLLARS ($0.00).

YOU ACKNOWLEDGE AND AGREE THAT THE SERVICE IS PROVIDED FREE OF CHARGE, AND THAT THE LIMITATIONS OF LIABILITY SET FORTH IN THESE TERMS REFLECT A REASONABLE ALLOCATION OF RISK.

7. No Reliance on Service

YOU ACKNOWLEDGE AND AGREE THAT:

  • You should not rely on the Service for making critical business decisions without independent verification
  • Any data, results, calculations, or information provided by the Service may be incorrect, outdated, or incomplete

BY USING THE SERVICE, YOU AGREE THAT ANY RELIANCE ON INFORMATION PROVIDED BY THE SERVICE IS AT YOUR OWN RISK.

  • Your violation of any third-party right, including any intellectual property right or privacy right
  • Any claim that your use of the Service caused damage to a third party
  • Any reliance on or use of data, results, or information obtained from the Service

9. Data and Privacy

You acknowledge that session data is temporary and will be deleted when sessions end. We are not responsible for preserving or backing up your session data.

10. Termination

We reserve the right to terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11. Service Modifications and Paid Features

We reserve the right, at our sole discretion and without prior notice, to:

  • Modify, suspend, or discontinue any part of the Service, including any features or functionality
  • Remove or restrict access to any features, content, or functionality currently available
  • Introduce paid subscription plans, premium features, or "Pro" modes that require payment to access certain features or functionality
  • Change any feature from free to paid without advance warning
  • Alter pricing, billing terms, or feature availability at any time
  • Impose usage limits, rate limits, or other restrictions on any features

You acknowledge and agree that we have no obligation to maintain any particular feature, maintain backward compatibility, or provide advance notice of changes to the Service. We are not liable to you or any third party for any modification, suspension, or discontinuance of the Service or any part thereof.

If we introduce paid features, your continued use of those features will constitute acceptance of the applicable fees and payment terms. We reserve the right to change or discontinue any paid features at any time without refund or credit.

The Service may contain links to third-party websites or services that are not owned or controlled by What's the Point?. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Service is operated, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or the Service shall be resolved through good faith negotiations. If negotiations fail, disputes shall be resolved in the appropriate courts of the governing jurisdiction.

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and What's the Point? regarding the use of the Service and supersede all prior agreements and understandings.
